Sexual harassment claims are now starting to be raised because of the amendment on 26 October 2024 to the Worker Protection (Amendment of the Equality Act 2010) Act 2023.
As a reminder, this preventative duty brought in a major shift in how workplace sexual harassment is handled. The key change is that ALL employers must take reasonable steps to proactively prevent sexual harassment.
Employers are required to undertake risk assessments and ensure they have relevant policies and training in place.
Failing to comply with the new duty can increase any compensation awarded by Employment Tribunals by 25%.
