Today is World AIDS Day

World AIDS Day takes place on 1 December each year and is an opportunity for people worldwide to unite in the fight against HIV. We come together to show support for people living with HIV and to commemorate those who have died from an AIDS-related illness.

Founded in 1988, World AIDS Day was the first ever global health day.

We thought it would be useful to highlight how HIV can come into employment scenarios and give some useful tips to employers.

Do you know that HIV is expressly deemed to be a disability for the purposes of the Equality Act 2010 (the Act)?  This means that a person with HIV is protected by the Act effectively from the point of diagnosis.

The Act prohibits discrimination in employment in respect of what are known as the protected characteristics (age, disability, gender reassignment, marital or civil partnership status, pregnancy and maternity, race, religion or belief, sex, and sexual orientation). HIV is automatically classed as a disability for the purposes of employment law, meaning that it is unlawful to discriminate against a worker who has HIV, or any of the other protected characteristics.
